Two legal categories come up a lot when talking about project-based work in Germany. Here’s what Factofly is based on, where it can fit, and where it doesn’t.

Not Scheinselbstständigkeit
Scheinselbstständigkeit is when someone is treated as a freelancer but legally meets an employee’s criteria.
That risk is the client’s. With Factofly, you’re actually employed for the duration of the project, by us. The category doesn’t apply.
Not Arbeitnehmerüberlassung (AÜG)
AÜG covers the rental of a named worker to a client who directs their day-to-day work. Factofly delivers a defined result, not a person. You stay independent in how you work. That’s the line that matters.
A project contract that holds up
The agreement with the client through Factofly is a project contract: a contract for a specific result.
We make sure the structure around it (employment, payroll, contributions) holds up under German law. That’s the part we’re rigorous about.
Project fit
Not every kind of work fits the model. Embedded roles, open-ended retainers, projects without a clear deliverable — those are usually a worse fit. We tell people that early rather than late.
