  • Client fills out the brief.

  • Factofly sends the client a formal offer based on the brief.

Formalisation

  • The client’s written acceptance is binding for two weeks.

  • We set up your employment contract.

  • You sign a fixed-term employment contract with Factofly covering the project.

  • Your gross salary is stated upfront.
  • You sign by QES or wet ink, depending on the project.

  • Once the contract is signed, the client is notified and the project can start.

Delivery and payment

  • You work independently on the agreed result.

The contract starts when the projects starts and ends when it ends. No notice period to worry about, no rolling employment.

2. Gross salary stated upfront

You see the number before you sign. Calculated from the project amount the client confirmed, after our 9% fee and employer contributions.

3. Project specific scope

The contract describes what you’ve agreed to deliver, not a generic role or job title. That specificity is what keeps it a contract for a defined result, rather than something that looks like employment.

4. Signed by QES

Both methods are recognised under German employment law.

Most projects sign by QES through our partner Scrive. Some still go by paper.

Not Scheinselbstständigkeit

Scheinselbstständigkeit is when someone is treated as a freelancer but legally meets an employee’s criteria.

That risk is the client’s. With Factofly, you’re actually employed for the duration of the project, by us. The category doesn’t apply.

Not Arbeitnehmerüberlassung (AÜG)

AÜG covers the rental of a named worker to a client who directs their day-to-day work. Factofly delivers a defined result, not a person. You stay independent in how you work. That’s the line that matters.

A project contract that holds up

The agreement with the client through Factofly is a project contract: a contract for a specific result.

We make sure the structure around it (employment, payroll, contributions) holds up under German law. That’s the part we’re rigorous about.

Project fit

Not every kind of work fits the model. Embedded roles, open-ended retainers, projects without a clear deliverable — those are usually a worse fit. We tell people that early rather than late.
